Last week the judge in the trial of Scott Roeder, who killed Dr. George Tiller in Kansas, ruled that Roeder can introduce a justifiable homicide defense to argue for a conviction for voluntary manslaughter. Kathy Spillar of the Feminist Majority says this decision may lead to more murders of doctors who provide abortion services. Audio 5:58

ReplyDeleteThis was NOT what the Judge ruled. He said that under the law it MIGHT be possible to argue for voluntary manslaughter but that it would be a large uphill battle for the defense and that the defense would have to proffer their witness on this point before they could even get in front of a jury. He specifically said that a necessity defense (justifiable homicide) could not be used.
Roeder needs to be held accountable for what he did. But, we need to let the court system do its job so this case does not have to be tried twice.
